GENERAL TRAVEL TERMS AND CONDITIONS (GTC)
Vintaggio Travels – Package Tours

1. Travel Organiser / Scope
1.1 These General Travel Terms and Conditions apply to all package tours organised by Vintaggio Travels within the meaning of sections 651a et seq. of the German Civil Code (BGB).

1.3 The basis of the travel contract is the respective travel offer and/or service description on the Vintaggio Travels website, the pre-contractual information, these General Travel Terms and Conditions, and the booking confirmation. The service description transmitted to the Traveller upon conclusion of the contract or made available in text form shall be decisive.
2. Non-binding Reservation and Conclusion of the Travel Contract
2.1 Booking requests by the Traveller are initially non-binding and do not constitute an offer to conclude a travel contract. On the basis of such an enquiry, Vintaggio Travels may provisionally and without obligation reserve travel services, without creating any entitlement to conclude a travel contract.
2.2 By booking the trip (e.g., by confirming the provisional reservation and providing the required participant data), the Traveller makes a binding offer to Vintaggio Travels to conclude a package travel contract.
2.3 The travel contract is concluded only upon receipt of the booking confirmation from Vintaggio Travels.
3. Right of Withdrawal
3.1 There is no statutory right of withdrawal for package travel contracts pursuant to sections 651a et seq. BGB. Instead, the Traveller has the statutory rights of cancellation and termination, in particular under clause 11 of these Terms and Conditions.
4. Travel Services
4.1 The scope of the contractual travel services follows from the respective service description, the pre-contractual information, and the booking confirmation.
4.2 In particular, tours offered by Vintaggio Travels include the following services:
- Accommodation
- Provision of an electrified historic Vespa (50)
- Guided tours
- Luggage transport
- Other services expressly listed in the service description
4.3 The vehicles provided are approximately 60-year-old, electrified vintage Vespas. Characteristics resulting from age and conversion—especially in appearance, operation, driving behaviour, performance, or range—do not constitute a travel defect, provided that the usability of the trip as a whole, as contractually presumed, is not materially impaired.
4.4 There is no entitlement to a specific vehicle model, a specific model year, a specific colour, or specific equipment features unless this has been expressly warranted in the contract.
4.5 As a rule, the Vespas provided are shared by two travel participants. The maximum payload per vehicle is 150 kg and must be observed by the travel participants at their own responsibility. Single use is possible only if booked in advance and subject to a separate surcharge. If single use has not been expressly added, two travel participants will share one Vespa.
4.6 The use of the vehicles provided is permitted only within the technical, design-related, and safety-related specifications. Details—especially permitted number of persons, weight limits, and vehicle-specific characteristics—follow from the respective service description.
4.7 If required for safety, maintenance, or technical reasons, Vintaggio Travels is entitled to provide a replacement vehicle.
4.8 Where individual services are provided by external service providers, Vintaggio Travels remains responsible as the travel organiser for the proper performance of the travel services included in the travel contract.
4.9 If, during the trip, the Traveller does not make use of individual travel services that are duly offered for reasons attributable to the Traveller, there is no entitlement to a pro-rata refund.
5. Participation Requirements / Driving Licence / Duties of Conduct
5.1 Only persons who have reached the age of 18 are eligible to participate as drivers of a vehicle.
5.2 Participation as a driver requires possession, for at least two years, of a valid driving licence in categories AM, A1, A2, A or B, or an equivalent driving licence recognised in the destination country.
5.3 The driving licence must be presented in the original at the start of the trip.
5.4 Each driver must be physically and mentally able to operate the vehicle safely. The Traveller must follow the instructions of the tour leader and guides.
5.5 Operating the vehicle under the influence of alcohol, drugs, or any other influence that impairs fitness to drive is prohibited. The same applies if the required driving licence is missing or if mandatory safety instructions are breached.
5.6 The Traveller must comply with all relevant road traffic regulations of the destination country and must treat the vehicle with due care.
6. Security Deposit / Insurance / Liability for Vehicle Damage
6.1 A security deposit in the amount of EUR 500.00 must be provided at the start of the trip for each vehicle made available. The deposit may be provided in cash or by real-time bank transfer.
6.2 The deposit secures due claims of Vintaggio Travels, in particular claims arising from self-inflicted vehicle damage, losses, missing accessories, or additional costs caused by the Traveller. It may be retained in whole or in part until such claims have been clarified to a reasonable extent.
6.3 The vehicles are covered by third-party liability insurance and fully comprehensive insurance in accordance with the respective insurance contract in force.
6.4 The Traveller’s deductible/excess is EUR 500.00 per claim.
6.5 In cases of intentional or grossly negligent damage—especially driving under the influence of alcohol or drugs, unauthorised handover of the vehicle to third parties, hit-and-run, or other serious breach of contract—the Traveller is liable without limitation in accordance with statutory provisions.
6.6 Fines, warning fines, toll charges, parking and towing costs, and other public-law or private-law claims arising from the Traveller’s personal use of the vehicle are borne by the Traveller. For processing such claims, Vintaggio Travels may charge the Traveller a reasonable administrative fee.
7. Luggage
7.1 Where luggage transport is part of the trip, it is carried out with the care customary in transport.
7.2 No special safekeeping of cash, jewellery, identity documents, electronic devices, or other valuables is owed. Such items must be carried and secured by the Traveller.
7.3 The Traveller must pack and label their luggage in such a way that ordinary transport stresses do not cause damage.
8. Payment
8.1 Payments towards the package travel price may be requested or accepted only if the insolvency protection certificate (Sicherungsschein) has been duly transmitted to the Traveller.
8.2 After transmission of (1) the booking confirmation, (2) the deposit invoice, (3) the information form for the Traveller for a package tour pursuant to section 651a BGB, (4) the General Travel Terms and Conditions and (5) the insolvency protection certificate, a deposit in the amount of 25% of the travel price is due.
8.3 The balance payment is due 45 days prior to the start of the trip. For bookings made within 45 days prior to the start of the trip, the entire travel price must be paid within 3 working days after transmission of documents (1), (2), (3), (4), and (5).
8.4 If the Traveller fails to make the deposit or balance payment despite it being due, although Vintaggio Travels is ready and able to duly perform the contractual services, and the Traveller is responsible for the default, Vintaggio Travels is entitled—after sending a reminder with a reasonable deadline and threatening cancellation—to cancel the travel contract and to demand cancellation costs in accordance with clause 11.
9. Price Changes After Conclusion of the Contract
9.1 Vintaggio Travels reserves the right to increase the travel price agreed in the travel contract in accordance with the statutory provisions if, after conclusion of the contract,
- the transport costs change due to higher costs for fuel or other energy sources,
- taxes or other charges for agreed travel services change, or
- the exchange rates applicable to the respective trip change,
and this has a direct effect on the travel price.
9.2 A price increase is permitted only if the Traveller is informed in writing of the increase and its calculation no later than 20 days before the start of the trip.
9.3 If the price increase exceeds 8% of the travel price, the Traveller may—within a reasonable deadline set by Vintaggio Travels—either accept the change or cancel the contract free of charge.
10. Changes to Services Prior to Departure
10.1 Changes to individual travel services after conclusion of the contract are permitted only insofar as they are minor, become necessary, and do not impair the overall character of the trip.
10.2 Vintaggio Travels will inform the Traveller in writing without undue delay after becoming aware of the reason for the change.
10.3 Material changes to essential travel services or a price increase of more than 8% entitle the Traveller, within a reasonable period, either to accept the change or to cancel the contract free of charge. If Vintaggio Travels offers an alternative trip, the Traveller may also choose that alternative trip.
11. Cancellation by the Traveller / Compensation
11.1 The Traveller may cancel the travel contract at any time prior to the start of the trip.
11.2 The decisive factor is receipt of the cancellation declaration by Vintaggio Travels. The Traveller is recommended to declare the cancellation in text form (e.g., by e-mail).
11.3 If the Traveller cancels prior to the start of the trip or does not commence the trip, Vintaggio Travels loses its claim to the travel price. Instead, Vintaggio Travels may demand reasonable compensation.
11.4 The lump-sum compensation per registered Traveller is:
- up to 90 days prior to the start of the trip: 0%
- 89 to 60 days prior to the start of the trip: 25%
- 59 to 45 days prior to the start of the trip: 50%
- 44 to 30 days prior to the start of the trip: 75%
- from 29 days prior to the start of the trip until the start of the trip / in case of no-show: 90%
11.5 The Traveller reserves the right to prove that Vintaggio Travels suffered no loss at all or a significantly lower loss. Vintaggio Travels reserves the right, instead of the lump sum, to demand compensation calculated specifically.
11.6 The Traveller’s statutory right to cancel free of charge in the event of unavoidable and extraordinary circumstances pursuant to section 651h(3) BGB remains unaffected.
12. Substitute Participant / Rebooking
12.1 Within a reasonable period prior to the start of the trip, the Traveller may declare in writing that a third party will enter into the rights and obligations under the travel contract in the Traveller’s place. A declaration received by Vintaggio Travels no later than seven days prior to the start of the trip is deemed timely in any case.
12.2 Vintaggio Travels may object to the entry of the third party if the third party does not meet special travel requirements or if statutory or official regulations prevent their participation.
12.3 If a third party enters into the contract, the original Traveller and the substitute participant are jointly and severally liable for the travel price and for the actual additional costs arising from the third party’s entry. Vintaggio Travels will provide the Traveller with proof of the amount of the additional costs.
12.4 There is no entitlement to rebooking after conclusion of the contract. If, at the Traveller’s request and subject to availability, Vintaggio Travels nevertheless carries out rebookings, the actual additional costs incurred may be charged.
13. Cancellation / Termination by Vintaggio Travels
13.1 The minimum number of participants is 4 persons, unless otherwise stated in the respective service description.
13.2 If the minimum number of participants is not reached, Vintaggio Travels may cancel in accordance with the statutory provisions and only if the minimum number of participants as well as the date by which the Traveller must receive the cancellation declaration at the latest were stated in the respective pre-contractual information and in the booking confirmation.
13.3 If Vintaggio Travels cancels the contract prior to departure due to failure to reach the minimum number of participants or due to unavoidable and extraordinary circumstances, payments made towards the travel price will be refunded without undue delay, no later than within 14 days after receipt of the cancellation declaration.
13.4 Vintaggio Travels may terminate the travel contract without notice if the Traveller—despite a formal warning—persistently disrupts the trip or breaches the contract to such an extent that immediate cancellation is justified. This applies in particular in cases of missing driving licence, serious breaches of safety instructions, endangering fellow travellers, or driving under the influence of alcohol or drugs.
13.5 If Vintaggio Travels terminates under clause 13.4, Vintaggio Travels retains its claim to the travel price; saved expenses and benefits from alternative use of services not used must be credited. Additional costs of return transport are borne by the Traveller insofar as the Traveller is responsible for them.
14. Travel Defects / Notice of Defects / Remedy / Termination
14.1 The Traveller must notify a travel defect without undue delay to Vintaggio Travels, the tour leader, or the contact point named in the travel documents.
14.2 If the Traveller fails to give notice, the Traveller cannot assert claims for price reduction or damages insofar as Vintaggio Travels had no opportunity to provide a remedy as a result.
14.3 If the Traveller demands a remedy, Vintaggio Travels must remedy the travel defect, insofar as this is possible and does not require disproportionate effort.
14.4 If the trip is impaired by a significant travel defect and Vintaggio Travels does not provide a remedy within a reasonable period set by the Traveller, the Traveller may terminate the contract. Setting a period is not required if a remedy is refused or immediate remedy is necessary.
15. Liability
15.1 The contractual liability of Vintaggio Travels for damages that are not bodily injuries and were not caused culpably is limited to three times the travel price.
15.2 This limitation of liability does not apply to damages arising from injury to life, body, or health, nor to other damages caused intentionally or negligently.
15.3 To the extent that international conventions or statutory provisions based on such conventions apply to a travel service to be provided by a service provider, under which a claim exists only under certain prerequisites or limitations or is excluded, Vintaggio Travels may invoke such provisions.
16. Limitation Period
16.1 Claims of the Traveller pursuant to section 651i(3) BGB become time-barred after two years. The limitation period begins on the day on which the package tour was contractually due to end.
17. Passport, Visa, and Health Requirements / Travel Insurance
17.1 Prior to conclusion of the contract, Vintaggio Travels informs the Traveller about general passport and visa requirements and health-policy formalities of the destination country insofar as these are relevant to the trip.
17.2 The Traveller is responsible for compliance with all statutory provisions relevant to carrying out the trip. Disadvantages resulting from non-compliance are borne by the Traveller, unless Vintaggio Travels culpably provided incorrect or incomplete information.
17.3 Vintaggio Travels recommends taking out travel cancellation insurance as well as insurance covering repatriation costs in case of accident or illness.
18. Insolvency Protection
18.1 Vintaggio Travels maintains the insolvency protection required by law pursuant to section 651r BGB.
18.2 The insolvency protection provider is: R+V Allgemeine Versicherung AG, Raiffeisenplatz 1, 65189 Wiesbaden, telephone: +49 611 533-5859. The legally required insolvency protection certificate will be transmitted to the Traveller prior to acceptance of payments.
19. Consumer Dispute Resolution
19.1 Vintaggio Travels is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
20. Choice of Law
20.1 German law applies. For consumers with habitual residence in another Member State of the European Union or the European Economic Area, however, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of their country of residence.
21. Severability Clause
21.1 The invalidity of individual provisions of the travel contract or these General Travel Terms and Conditions does not result in invalidity of the entire travel contract.
